Terms of Service
The agreement between you and BARRACUDA BEACH HOUSE, LLC when you use this site.
These Terms of Service ("Terms") govern your access to and use of https://barracudadiner.com and the services offered by BARRACUDA BEACH HOUSE, LLC ("we," "us," or "Barracuda Diner"), including our recipe membership and kitchen store. Please read them carefully.
1. Acceptance of These Terms
By creating an account, starting a free trial, placing an order, or otherwise using the site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site. You must be at least 18 years old, or the age of majority where you live, to purchase a membership or place an order.
2. Membership and Subscription Billing
A Barracuda Diner membership gives you access to our full library of recipes and a member discount in the kitchen store for as long as your membership is active. Membership is offered on two plans:
- Monthly plan: $8.49, billed every month.
- Annual plan: $89.49, billed once per year.
3. Automatic Renewal
In plain language: your membership renews itself so you never lose access by accident. When you join, you authorize us to charge your payment method on a recurring basis. A monthly plan charges $8.49 at the start of each month, and an annual plan charges $89.49 once a year. These renewals continue automatically until you cancel. We will email you a receipt after every charge. If our prices change, we will tell you in advance and the new price will apply only to renewals after that notice.
4. 30-Day Free Trial
New members are eligible for a 30-day free trial with full access to all recipes. We do not charge you during the trial. Your first payment is taken at the end of the 30 days unless you cancel before the trial ends. The free trial is limited to one per customer. If you have used a trial before, joining again starts a paid membership immediately.
5. How to Cancel
You can cancel your membership at any time from your account page, or by emailing info@barracudadiner.com. Cancelling stops the next renewal. You keep access for the remainder of the period you have already paid for, and you will not be charged again after that. Cancelling during your free trial means you are never charged. Refunds, where applicable, are handled under our Refund Policy.
6. Kitchen Store Orders and Shipping
Products in our kitchen store are sold subject to availability. Prices and descriptions may change, and we may correct errors, cancel orders affected by a pricing mistake, or limit quantities. Shipping is free on orders over $75.00 and otherwise costs a flat $6.99 within the United States. Title and risk of loss pass to you when the carrier takes possession of your order. Returns and refunds for store items are governed by our Refund Policy.
7. Acceptable Use
You agree not to misuse the site. In particular, you will not share your account credentials, scrape or bulk-download our recipes, republish our content, attempt to bypass the membership paywall, interfere with the operation of the site, or use the site for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.
8. Intellectual Property
All recipes, text, photographs, logos, and other content on the site are owned by BARRACUDA BEACH HOUSE, LLC or its licensors and are protected by copyright and other laws. Your membership grants you a personal, non-transferable license to access and cook from our recipes for your own household use. It does not transfer any ownership rights, and it does not permit you to copy, distribute, sell, or publicly post our content.
9. Disclaimer of Warranties
The site, the recipes, and the products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that recipes will produce a particular result. Cooking outcomes depend on your ingredients, equipment, and technique. 10. Limitation of Liability
To the fullest extent permitted by law, BARRACUDA BEACH HOUSE, LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the site. Our total liability for any claim relating to the site or services will not exceed the amount you paid us in the 12 months before the claim arose.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute not subject to arbitration.
12. Binding Arbitration and Class Action Waiver
Please read this section carefully, as it affects your legal rights. Any dispute or claim arising out of or relating to these Terms or your use of the site will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. You and we agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this class action waiver is found unenforceable, the entire arbitration provision will be void.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated where appropriate. Your continued use of the site after changes take effect means you accept the updated Terms.
